1. You must be at least 18 years old to use the Gorilla Box storage service. By registering to use our storage service, you represent and warrant that you are 18 years of age or older.
1.1 We reserve the right at any time to modify this agreement and to change, impose new or additional terms & conditions. Such modifications and/or additional conditions will be notified to you in writing, by post or email. Unless a discontinuation of service is explicitly requested we will be entitled to take this as acceptance of the new or amended conditions. If you do not wish to accept the new or amended conditions, you may terminate this agreement, without charge, at any time before the new or amended conditions take effect by notice in writing to us.
1.2 We may refuse or may cease to provide the Gorilla Box storage service where we consider that it is or may be used in breach of our terms of service or for any unlawful or improper purpose or for any other reason.
1.3 We reserve the right to suspend access to, or withdraw all or any elements of this site wwwgorillaboxuk.com and to restrict access to some parts of this site to registered users only. We shall have no liability for unavailability of this site and reserve the right to make changes to this site at any time without notice.
2. Storage of goods are at the sole the risk of the owner. They will be responsible for and bear the risk of any and all theft, damage to, and deterioration of the goods except where it is caused by our negligence or breach of contract.
2.1 We provide insurance up to the value of £100.00 for each Gorilla Box and the goods within it at all times, from collection until return delivery, against all normal perils. Normal perils in this condition mean actual loss of or damage to goods caused by fire, lightning, explosion, earthquake, storm, flood, escape of water fromany apparatus, theft by violent or forcible means, subsidence, riot and civil commotion, malicious damage, impact by vehicles, aircraft or aerial devices, vermin damage, collapse or partial collapse of building.
2.2 Our total liability for theft, damage to, and deterioration of the goods or other loss shall be limited to the sum of £100.00 or that stated by additional cover purchased, even if the actual loss suffered is more than that.
2.3 An excess of £20.00 is applicable for all claims against the £100.00 cover provided with all Gorilla Boxes. This initial £100 cover is null and void and an excess of £100.00 is applicable for all claims in the instance additional cover has been purchased.
2.4 We reserve the right to request proof of value of the items as well as proof of their condition prior to collection and following their immediate return. Items may be repaired, replaced like for like or like for new, as we deem is fair.
3. We aim to fulfil all specified delivery and collection slots but reserve the right to amend these as and when our schedule and circumstances, both within and outside of our control dictate. We do not accept responsibility for any cost or hardship caused as a result of to delays within our scheduling or extended logistics network, or failure to fulfil a requested collection or delivery slot.
3.1 Gorilla Box will utilise employees within the company or contractors within our extended logistics network to fulfil the services we offer and any obligations we hold. However, we do not accept responsibility or liability for all parties acting on our behalf and are considered a separate legal entity.
3.2 A return delivery through our extended logistics network may or may not include removal of the GorillaBox and pallet. If these items are not removed at the point of return delivery, the named individual on the initial booking assumes responsibility for their disposal.
4. We collect information about Gorilla Box customers at the point of payment and whilst this agreement continues, including personal data which we process in accordance with the Data Protection Act 1998 or such other applicable law which may supersede the Data Protection Act 1998 in the future.
4.1 We will use your data for the purposes of this agreement, to process payments, communicate with you and generally maintain your account.
4.2 We may share data with, and collect information from, credit reference or fraud prevention agencies (including Police, Counter Terrorism and HM Customs & Excise) and Debt Collection agencies. We will release this data and other account details at any time if we consider in our sole discretion this is appropriate: (a) to comply with the law; (b) to enforce this agreement; (c) for fraud protection and credit risk reduction; (d) for crime prevention or detection purposes.
4.3 If we sell or buy any business or assets, we may disclose data and account details to the prospective seller or buyer of such business or assets. If all of our assets are acquired by a third party, all data and account details will be one of the transferred assets.
